The Fourth and Eighth Amendments of the Constitution of the United States protect the rights of the people against "Unreasonable searches and seizures" and against " Cruel and unusual punishments".
The 'reasonableness' of a particular use of force must be judged from the perspective of a reasonable officer on the scene, and there must be an allowance for the fact that officers are often forced to make split-second decisions about the amount of force necessary in a particular situation. The Fourth Amendment 'reasonableness' enquiry is whether the officer's actions are 'objectively reasonable' in view of the facts and circumstances confronting them, without regard to their underlying intent or motivation. Grahm v. Connor, 109 S. Ct. 1895, (1989).
The Courts stated that claims of excessive use of force must be judged by the Fourth Amendment's requirement that searches and seizures be "reasonable." By general definition, reasonable means "logical, rational, sensible, sound, and wise." How does this general definition of reasonable relate to the legal Constitutional definition of reasonable? Objectively reasonable people would agree that the use of force in making an arrest, investigative stop, or other officer - citizen contact situation, must be "logical, rational, sensible, sound and wise." In a sense then, the law enforcement or security representative must be able to defend their actions by this standard.
This training includes all the techniques, and practice so that, students will perform as professionals. The techniques, levels of force and tactical application, are reasonable, practical and effective in real situations. The officer first learns how the mind and body work; principles of balance and psychology - centering, speed and power; how the body works (mechanically) to attack / defend / control / resist; what and how humans perceive, pay attention to, remember, learn, and decide - especially in confusing, stressfull and emergency conditions; what happens during and after critical incidents.
The officer is taught practical effective control & defensive tactics for use in real life situations and how to maintain his focus and concentration during these situations.
After the defensive tactics and techniques have been learned, the officer is taught how to use them through actual simulation training. All of the officers newly learned skills are put to the test. The officer will actually control a real resister and assailant using the techniques and tactics he has learned. He will hit and get hit for real, this will better prepare him for real situations. These techniques are designed to control even larger, stronger and extremely agitated people with minimal injury. The pain and injury that one may sustain as a result of these techniques, are temporary and do not generally require medical attention. One must understand that dynamic activity of any kind may produce accidental injury to persons or property. The officer is also trained in trauma control techniques and anti-injury exercises which will help the officer to prevent injury to himself during actual situations.
This material is presented in an understandable way and serves to help the officer avoid panic and make beneficial split second tactical decisions.
This training is designed to prepare the officer to establish and maintain lawful control of assailants and resisters. Prior to participating in this training, it should be understood that persons trained in these tactics and procedures probably will not perform perfectly in actual situations which may be highly unpredictable, confusing, or dynamic. We cannot guarantee the absence of possible injury or litigation resulting from the use of physical control tactics.
Upon successful completion, the student will earn a “Certificate", and It is strongly recommended that each student attend an organized practice session on a monthly basis to keep their skill level at an “acceptable effective “ standard.
