Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted. |
This Amendment covers two very important legal concepts: What is considered excessive bail has been debated in the courts for many years, but usually is decided by the judge determining bail and usually depends on the circumstances raised by both your attorney and the prosecuting attorney. What is cruel and unusual punishment for the crime committed originates from the Code of Hammarabi, "an eye for an eye". There are many arguments for and against capital punishment and how that punishment is inflicted (by gas, electric chair, etc.) that are still being debated today. |
