of said dec'd and John W. Adams to have the creek (Bear Creek which is
the line between the lands of said parties) straightened by a CANAL the

Isbell by reason of said canal.

The petition of James J. Isbell Executor of Allen Isbell dec-d showeth that his testator, late of said couty departed this life, leaving as a part of his estate, one tract of land in said county on waters of Bear Creek and North Broad River adjoining lands of T.P. Wilkinson, Isaac Tabor and Rich-d Wheeler containing two hundred and eleven acres more or less. Also one lot of land in said county adjoining the above, and lands of T.P. Wilkinson and others containing Thirty Acres more or less.
Also one lot of land in said county being the place whereon Testator lived at the time of his death, adjoining T.P. Wilkinson, J.S. Wheeler and other, containing forty acres more or less.
Also one lot containing one hundred acres more or less in the woods adjoining lands of Elgin Kay, Warren Stows and others.
Your petitioner further shows that by the will of his testator, said lands as well as other property of testator even devised, and bequeathed to his wife now widow, Cynthia during her life or widowhood.
And your petition further shows that said Cynthia has by her deed properly Executed which is herewith to the court shown entirely and completely for a valuable consideration Relinquished unto your petition and the other ligaters under said will all her right, title, claim and interest which she has in and to said lands and other estate by virtue of said will.
Now your petitioner shows that it is impossible to distribute said estate under said will and in accordance with said Deed of Relinquishment except by the sale thereof.
Wherefor he prays the Judgement of the court granting an order to sell the lands belonging to said estate.

It appears to the Court that the fact set forth in the above petition are true and it further appearing that no objection have been filed to the granting of the order as prayed for in said petition. It is ordered that said Executor have leave to sell said land upon giving notice of such sale in terms of the law.

The petition of James J. Isbell of said state and court shows that he desires to be appointed by the Court of Ordinary of said county, Guardian of the person and property of said Mary E. Isbell, a minor of Allen Isbell late of said count deceased, who is under the age of fourteen years and a resident in said county.
Wherefore he prays that citation may issue in terms of
the law requiring all persons concerned to show cause why letters of Guardianship
of the person and property of said Mary E. Isbell should not issue to him
at the November term of the Court of Ordinary 1870.

Isbell a minor resident of said county having been duly made and citation duly issued and no objection being offered and this Court being morsoever fully satisfied that said James J. Isbell is a fit and proper person- to be appointed, Mary E. Isbell's Guardian, both of her person and property. It is therefore ordered by the Court that said James J. Isbell be and he is hereby appointed Guardian of the person and property of Mary E. Isbell and that he give bond and Security in the Sum of ________ (left blank) ____ Dollars and take the usual oath of office and it is further ordered that he be allowed to give bond and qualify in vocation or at some future term of this Court.

And now at a regular term of this court coming N.J. Isbell a minor child of Allen Isbell and filing petition to have James J. ISbell appointed his Guardian in conformity with the law and showing to the court that he is fourteen years of age. It is ordered by the Court that said James J. Isbell's person and property, upon his giving hand and Security in the taking the usual oat of office and it is further ordered that he be allowed to qualify and gives bond in vacating or at some future term of the court.

The petition of Newton J. Isbell shows that he is a minor child of Allen Isbell late of said county deceased that he is over fourteen years of age that entitled to select his own guardian, he now exercises that rught and selects James J. Isbell of said county to be his guardian.
Wherefore he prays openly here of his said selection be
deemed judicious to appoint said James J, Isbell the guardian of his property
and person in terms of the law in such cases made and provided.
