WILL OF JAMES ISBELL

In the name of God Amen.  I James Isbell of the county and State aforesaid being old and infirm
and knowing that all men must die do make this my last will and Testament hereby revoking all
former wills by me made.

Item 1st It is my will that my just debts be paid .

Item 2nd It is my will and I do hereby give and bequeath to my two grand daughters Nancy Jane
and Ludia Ann Isbell Daughters of my son James L, Isbell deceased two hundred and fifty acres
of land more or less lying and adjoining John Moss and Pendleton  (? F.) Isbell the line to run
as was agreed upon between my  son James  L.  dec'd and my son P. F. Isbell until it comes to
the forks of the branch then up the meanders of said forks of the branch The left hand prong of
said branch to to it's head source then a due north course until it strikes the back line which
tract of land  I give to my said grand Daughter to be theirs at the death of my self and that
of my wife and not before. It is also my will should  my  said grand Daughter die leaving no
children the said land shall go to and be equally divided between my sons P.F. Isbell and,
Allen Isbell, Jabez (?) Isbell and my daughter Nancy who married Wilbourn Smith.

Item 3 It is my will and I do hereby give and bequeath to my son Allen Isbell the tract of land
where on he now lives also the tract of land on bear creek adjoining Wilkenson and P.F. Isbell.
Also one hundred acres of land adjoining of Kays Akins and  (?)

Item 4 th I give and bequeath to my son Pendleton F. Isbell the tract of land whereon I now
live as heretofore deeded off to him also one negroe boy  by the name of Alford about twelve
years of age.

Item 5th  It is my  will that all the balance of the property both real and personal  that I
may disposesed of it at the time of my death equally divided between my three sons P.F. Isbell,
J.P. Isbell, and Allen Isbell and my daughter Nancy Smith wife of Wilbourn Smith.

Item 6th It is my will and I do hereby  nominate constitute and appoint my son Pendleton F.
Isbell  Executor to this my last will and testament.

Item 7th Plot in the will in the second item there of made before it was signed. In Witness
where of I have set my hand and affixed my seal.
This the 27th day of September 1859.

Before me on the 13th day of January 1862 at chambers for the purpose of proving the last will
and testament of James Isbell the witnesses to said will Viz Thomas Morris, W. M. Hunter and
the will having been before that time brought before me for probate by the Excutor Pendleton F.
Isbell who has filed a petition for probate for the same they saw said witness depose of the
same that they saw said James Isbell sign and publish the same as his last will on the day and
year then stated as executed by him that they witnessed the same as his request in his presence
and in the presence of each other that the same was voluntarily executed by him while he was of
sound and disposing mind and memory and that they saw James W. (?) do likewise. Sworn to and
subscribed before me.

Ordered that the will be admitted to record as satisfactorily proven in common form and that
the executor Pendleton F. Isbell have leave to qualify and upon so doing that letter
testamentary pass to him.
