Henry Hess's Will


I Henry Hess of Russell County Virginia being old and knowing the shortness of life and certainty of death and yet retaining my natural mind and having some personal property that I wish to dispose of and will as suits me. I there for make the following my last will and testament and by revoke all former wills by me made.

First of all I desire all my debts paid and a decent burial for myself and my wife Millie Hess. In case my wife outlives me I want her to have all my personal property during her widowhood to use for her to have a decent Support. And when we have each deceased, if there be any personal property left it shall be equally divided between Fullen Hess, Louisa Peck, James Hess, John H. Hess, Ira Hess, and one dollar to Polly Miller's heirs and one dollar to Harvey Hess's heirs. I now commend my spirit to a merciful God who gave it and my body to the dust. In witness of this my last will and testament I here unto set my hand and seal in the presence of the undersigned witnesses. This the 21st day of January 1903.

1904 Sept 6th
Virginia: In the Clerks office of Russell Circuit Court of Russell County the 6th day of September 1904. The last will and testament of Henry Hess, was this day produced in the Clerks Office aforesaid and proved by oaths of E.D. Miller and J. S. Stinson the two subscribing witnesses there to, who testified that they witnessed said will at the request of each other. Therefore it is ordained that the said will be recorded & filed away in the Clerks Office as required by law.
